SEREMBAN -A secretariat representing the Undang Yang Empat and Tunku Besar Tampin wants the Attorney General's Chambers (AGC) and the state secretary to review their decisions that an enquiry process to remove Tuanku Muhriz Tuanku Munawir as the state ruler was not carried out in accordance with the Laws of the Constitution of Negeri Sembilan 1959.In a statement, the secretariat said it also believed the AGC had no right to interfere in Negeri Sembilan's internal affairs and should not act as a judge to dispute the state exco's decision to accept a Proclamation removing Tuanku Muhriz."We wish to emphasise that the investigation process regarding the misconduct of Tuanku Muhriz was carried out during the meeting of the Dewan Keadilan dan Undang (DKU) on March 5 and was followed by a further investigation by the Undang Yang Empat on April 19, 2026."The investigation report detailing Tuanku Muhriz's misconduct was also presented to the Yang di-Pertuan Agong on August 26," they claimed on Friday (Sept 18).The secretariat said the statement by the AGC was highly misleading as it gives the impression that the state exco had acted wrongfully in agreeing to remove Tuanku Muhriz.On the contrary, the secretariat said the decision to remove Tuanku Muhriz was made by the Undang Yang Empat under their prerogative powers."The action of the state exco to accept the Proclamation should instead be appreciated by the AGC for upholding the principle of constitutional supremacy."These facts clearly demonstrate that the processes and procedures required under Article 10 of the state laws had already been complied with before the Proclamation of April 19 was issued."This directly contradicts the allegation made by the AGC stating the absence of facts regarding compliance with the said procedures," it said.On Thursday (Sept 17), the AGC said the Negeri Sembilan Mentri Besar and the state exco had no unilateral power to depose or vacate the office of Yang di-Pertuan Besar Tuanku Muhriz Tuanku Munawir.The AGC said the validity and legal effect of such a proclamation must instead be determined through the constitutional and legal processes provided under the state laws.The AGC said it found that the proclamation was invalid as it had failed to comply with the mandatory requirements under Article 10 of the state Constitution.The secretariat said the state secretary should also resign for failing to act on the state exco's directive to gazette the proclamation."This is because the state secretary is duty-bound to obey the instructions of the government of the day instead of receiving instructions from unrelated external parties who have no business with the state administration," it said.The secretariat added that the gazetting of the Proclamation was not a condition for it to become valid.A proclamation, they said, becomes valid and complete once all signatories have appended their signatures.Regarding the proceedings in the High Court of Malaya in Seremban referred to by the AGC as still ongoing, the secretariat said those proceedings only touched upon the issue of a claim for the production of the DKU meeting minutes dated April 17."The proceedings do not touch upon the question of the validity of the April 19 Proclamation at all."Furthermore, regarding the interlocutory injunction referred to in the statement, it is actually an ad interim injunction which, among other things, relates to the DKU to maintain its status quo as of May 21, 2026," they said.Based on the status quo as of May 21, the secretariat said the lawful Undang Yang Empat were Datuk Mubarak Dohak (Undang Sungei Ujong), Datuk Maarof Mat Rashad (Undang Jelebu), Datuk Mohammed Abdullah (Undang Johol) and Abdul Rahim Yasin (Undang Rembau), together with Tunku Besar Tampin Tunku Syed Razman Tunku Syed Idrus al-Qadri and Dato' Shahbandar Sungei Ujong Datuk Seri Badarudin Abdul Khalid.The secretariat also disputed the list of Undang which was issued following the meetings of the DKU on July 31 and Sept 13

KUALA LUMPUR - The April 19 proclamation concerning the position of Yang Dipertuan Besar Negeri Sembilan Tuanku Muhriz Tuanku Munawir is invalid as it did not comply with the mandatory requirements under Article 10 of the Laws of the Constitution of Negeri Sembilan 1959 (UUTKNS 1959), according to the Attorney-Generals Chambers (AGC).In a statement last night, the AGC said there was no evidence that any of the disqualification grounds specified under Article 10(1) of the UUTKNS applied to Tuanku Muhriz.The AGC also stressed that the Menteri Besar and Negeri Sembilan State Executive Council (Exco) did not have unilateral power to depose or vacate the office of the Yang Dipertuan Besar."The validity and effect of the proclamation concerning the matter must be determined through valid constitutional and legal processes, in accordance with the law, particularly the UUTKNS 1959, it said.The AGC said that while the Undang had the authority to take action to remove the Yang Dipertuan Besar, Article 10 of the UUTKNS also sets out the procedures and grounds that must be considered before such a decision can be made."As of today, there are no facts indicating that the prescribed procedures have been complied with," it said.The AGC said questions had also arisen over whether several Undang who signed the proclamation were still lawfully holding office, as they had been removed according to the adat (customary practices) in their respective Luak.The department said the validity of several Undang who signed the proclamation was disputed because their removal had been carried out according to the adat of their respective Luak, resulting in an incomplete composition of the Undang Yang Empat at the material time."The department respects the position of the Undang of Negeri Sembilan and acknowledges that the appointment and removal of each of them are subject to the adat of their Luak," it said.Meanwhile, the AGC noted that Article 16 of the UUTKNS 1959 provides that matters concerning Malay customs, including the selection, appointment, abdication and removal of the Undang, as well as any matters brought before it by the Yang Dipertuan Besar, fall under the jurisdiction of the Dewan Keadilan dan Undang (DKU)."Under Article 16(3) of the UUTKNS 1959, the advice of the DKU on such matters is final and cannot be challenged or questioned in any court on any grounds," it said.As such, the AGC said media statements or announcements by members of the State Exco on the matter had no legal effect, as they had no jurisdiction, authority or power under the UUTKNS 1959 to make such announcements."There is also no legal basis for Exco members to rely on the April 19, 2026 proclamation for their announcements."Based on the matters above, any gazettement or implementation of the proclamation would be invalid as it is unconstitutional," it said.The AGC also noted that the matter was currently before the High Court in Seremban and that an interlocutory injunction remained in force.The department therefore urged all parties to respect the court process and allow the matter to be resolved in an orderly manner.The AGC issued the statement after taking note of the Sept 15 media statement by the State Exco on its decision concerning the proclamation.Earlier today, media reported that Menteri Besar Datuk Ismail Lasim had confirmed that the proclamation had been unanimously decided and endorsed by the State Exco.The DKU, on the other hand, reiterated that Tuanku Muhriz Tuanku Munawir remains the lawful ruler of Negeri Sembilan and chairman of the council

SEREMBAN - Tuanku Muhriz Tuanku Munawir remains the legitimate Yang di-Pertuan Besar of Negeri Sembilan, says the Dewan Keadilan dan Undang (DKU).Its secretary Raja Norazli Raja Nordin said Tuanku Muhriz was also the chairman of the DKU, the highest authority on Undang (ruling chiefs) related matters in the state.He said according to Article 16 of the Laws of the State of Negeri Sembilan 1959, matters related to Malay customs, including the selection, appointment, abdication and removal from office of the Yang di-Pertuan Besar and the Undang, fall under the jurisdiction of the DKU.He said the DKU's advice on such matters was final and cannot be challenged or questioned in any court on any grounds whatsoever."The state executive council and the state government do not have the jurisdiction to determine the validity of the said proclamation or the position of the Yang di-Pertuan Besar."The decision of the state exco dated Sept 16 has no legal effect," he said.In a press statement yesterday (Sept 16), the state exco had purportedly said that Tuanku Nadzaruddin Tuanku Ja'afar was now the Yang di-Pertuan Besar in place of Tuanku Muhriz.They claimed the decision was made during an exco meeting chaired by Menteri Besar Datuk Ismail Lasim on Sept 15.They said an April 19 proclamation removing Tuanku Muhriz under Article 10 of the state laws had been signed and sealed by the lawful Undang, and became complete when Ismail signed it on Aug 3.Attempts to get a response from Ismail's office were unsuccessful.Raja Norazli said the customary institutions of Negeri Sembilan, including the institution of the Yang di-Pertuan Besar and the institution of the Undang, do not belong to any political party or individual, but are a trust for all subjects (anak buah) and heirs (waris)."The DKU hereby urges all parties to uphold the Laws of the State of Negeri Sembilan 1959, respect the jurisdiction and determinations of the DKU, and resolve any disputes through valid constitutional and legal processes," he said in a statement.Raja Norazli said yesterday's (Sept 16) announcement which purportedly legitimises the removal of Tuanku Muhriz, recognises the selection of a new Yang di-Pertuan Besar, and calls for its immediate implementation was not enforceable as it was outside the jurisdiction of the state executive council.The DKU also welcomed a statement by Menteri Besar on Sept 15 which affirms that he does not possess unilateral power to terminate or vacate the office of the Yang di-Pertuan Besar, and that the validity and effect of the said proclamation must be determined through valid constitutional and legal processes, including through judicial determination.Raja Norazli reiterated that an April 19 dated proclamation on the removal of Tuanku Muhriz was defective from the outset.This, he said, was because no inquiry under Article 10(1) of state laws was ever conducted and that three of the four individuals who signed it did not hold the office of Undang on the said date.He said the proclamation had also lapsed and became void following the refusal of the then Mentri Besar to sign it."Any proclamation claiming to select a new Yang di-Pertuan Besar rests on the same defective foundation and was signed by individuals who do not validly hold the office of Undang."It is also void and has no legal effect," he said.Raja Norazli said the prerogatives of the Undang Yang Empat referred to in the Sept 16 announcement can only be exercised by Undang who hold office legally and according to the conditions and procedures established by the Constitution."Since those conditions and procedures were not met, no such valid prerogative arises," he said.Raja Norazli also reminded all parties that since the matter was still before the courts, they should refrain from taking any steps that could interfere with the process

SEREMBAN - The Dewan Keadilan dan Undang (DKU) and its secretary intend to initiate contempt proceedings against Menteri Besar Datuk Ismail Lasim and members of the state executive council over their statement on Wednesday concerning the position of the Yang di-Pertuan Besar of Negeri Sembilan.Lawyers representing the DKU and its secretary said their clients were shocked by the statement, which declared that the earlier proclamation removing Tuanku Muhriz Tuanku Munawir as Yang di-Pertuan Besar was valid.They said Ismail, the state executive council, state secretary and state legal adviser had no jurisdiction, authority or power to make such a declaration.The lawyers maintained that the announcement was unconstitutional, void and had no legal effect."It is our clients' firm view that your conduct in issuing the announcement is to subvert the executive authority of Tuanku Muhriz Tuanku Munawir under the Laws of the State of Negeri Sembilan 1959 and is further intended to overthrow and dethrone Tuanku Muhriz."Your conduct is tantamount to a coup d'tat and an act of treason, which should be punishable under the Penal Code and all other relevant laws," they said in a letter to the parties concerned.The lawyers also argued that the April 19 proclamation relied upon in Wednesdays announcement was null and void as it did not satisfy the mandatory requirements under Article 10 of the Laws of the State of Negeri Sembilan 1959.That proclamation purportedly removed Tuanku Muhriz and stated that the Undang Yang Empat had elected Tuanku Nadzaruddin Tuanku Ja'afar as the new state ruler.The lawyers pointed out that Ismail had, on behalf of the state executive council, issued a statement on Tuesday acknowledging that the Menteri Besar had no unilateral power to remove or declare vacant the office of the Yang di-Pertuan Besar.Ismail had also said the validity and effect of the purported proclamation should be determined through the proper constitutional and legal processes, including judicial determination.The lawyers said Wednesdays announcement was also in breach of injunctive orders issued by the High Court on June 5."Our clients take the view that your announcement is violative of the injunctive orders of June 5 for the same reasons for which the High Court issued leave for contempt proceedings on July 8, 2026."As such, our clients intend to commence contempt proceedings against you for the abovementioned breaches of the injunctive orders of June 5, 2026," they said.They said the June 5 orders restrained the Undang Yang Empat and two others from taking steps or making decisions concerning the administration, governance, proceedings, authority and affairs of the DKU.The lawyers argued that the purported appointment of a new Yang di-Pertuan Besar while those orders remained in force amounted to a breach of the injunction.They also noted that the High Court had on July 8 granted their clients leave to commence committal proceedings against the parties concerned over the alleged breach of the June 5 orders

SEREMBAN The Undang Luak Rembau, Datuk Sedia Raja Hassan Ab Hamid, has stressed that statements or decisions made by the Negeri Sembilan State Executive Council (MMK) cannot override the Undang-Undang Tubuh Kerajaan Negeri Sembilan (UUTKNS) 1959.He said an MMK decision could not, by itself, revive or validate a proclamation that had already been declared invalid by the Dewan Keadilan dan Undang (DKU).The DKU decided on July 31, 2026, and reaffirmed on Sept 13, 2026, that the proclamation dated April 19, 2026, is invalid and that Tuanku Muhriz Tuanku Munawir remains the Yang di-Pertuan Besar of Negeri Sembilan.Accordingly, all parties must respect the UUTKNS, the jurisdiction of the DKU and decisions made within its lawful authority, he said in a statement.The statement was issued following a media statement on behalf of MMK members concerning the April 19, 2026 proclamation, which was said to concern the position of Tuanku Muhriz.He added that the Royal Institution and the institution of the Undangs in Negeri Sembilan must be preserved with the utmost decorum and respect, stressing that no individual, administrative body or Exco meeting could place itself above the UUTKNS.All parties must uphold peace in Negeri Sembilan and refrain from actions that could cause confusion in state administration or undermine the dignity of the royal and customary institutions of Negeri Sembilan, he said.Hassan said a matter of such importance must be addressed with proper decorum and in accordance with the UUTKNS 1959, rather than being determined solely through administrative decisions or media statements.The core issue is not simply whether the Four Undangs have the power to elect or remove the Yang di-Pertuan Besar.Rather, the fundamental question is whether that power was exercised in full compliance with all the conditions and procedures prescribed by the UUTKNS
